A lawyer who represented a number of defendants in high-profile criminal cases last year received nearly €700,000 in criminal legal aid, according to new figures. He seeks to quash the Board`s refusal to pay his lawyers` fees or his subsequent application for review of that decision. Dublin-based lawyer Michael Hennessy recently said: “Lawyers and lawyers have been key workers during the pandemic, providing day-to-day legal services despite the lockdown and at a pay rate that was cut by 40% during the austerity measures and has remained at that level ever since.” Michael Bowman SC is the country`s most wanted defense lawyer, earning an average of €13,309 per week in criminal justice payments last year for his defense work in court. In his most recent case, Thompson says that after his case closed in 2019, a Supreme Court judge recommended that his legal fees be covered by the legal aid (custody) program. The state`s top legal aid lawyers earned up to €690,000 last year, with total payments under the criminal legal aid programme exceeding €68 million, according to new figures. In an August 2020 decision, reiterated in March 2021 following a request for review of the original decision, the Legal Aid Committee refused to grant an exemption from Mr. Thompson`s legal fees. The law firm Cahir OâHiggins, a lawyer specializing in criminal defense, received just over 291,955 euros in legal aid last year. The new figures show that lawyers and lawyers received €68.18 million in payments under the legal aid scheme last year, up 18.7% from €57.42 million in 2020. A number of lawyers protested this week in criminal courts against the amount of fees paid to them under the criminal legal aid programme. Convicted criminal Freddie Thompson filed a lawsuit in the Supreme Court over the Legal Aid Board`s refusal to cover his legal fees for a case he took over in 2019 over prison conditions.
Figures presented by the Department of Justice show that the office of lawyer John M. Quinn received the highest amount among criminal legal aid lawyers last year, at €746,012. The respondents did not accept that the move was due to Thompson`s legal action. The increase in legal aid in criminal cases over the past year is partly due to a sharp increase in the number of certificates issued, due to the increase in judicial work. Thompson, originally from Dublin`s south city centre, is serving a life sentence following his conviction for the murder of David Douglas at Portlaoise prison in 2018. Michael Bowman SC led the ranking of senior counsel with payments of €692,095 in 2021, with Padraig Dwyer SC being the second best winner with €599,488. Mr. Bowman also represented the state in the unsuccessful appeal of Patrick Quirke, 53, against his conviction for the murder of Bobby Ryan, known as “Mr. Moonlight”.
Mr. Bowman receives separate honoraria from the DPP for his prosecution work. Mr Bowman also represented Darren Redmond, 27, of Caledon Road, East Wall, Dublin, who was sentenced to 18 years in prison, the last three years of which were suspended, for his role in the kidnapping and serious injury of businessman Kevin Tunney. That case, which has been before the courts several times, was finally withdrawn in November 2019 after Thompson was removed from segregation by prison authorities and integrated into the general population. The detailed breakdown shows that the only two other lawyers who received more than €500,000 last year – Patrick Dwyer SC, who received €599,488, and Keith Spencer BL, who received €550,001. Figures show that lawyers shared €40.28 million, while lead lawyers received €10.48 million and junior lawyers €17.42 million. Leave to file the complaint was granted Monday by Judge Charles Meenan. He returns in October.
